Terms & Conditions
Effective Date: October 1, 2025
These Terms & Conditions (“Terms”) govern your access to and use of the Cristeros websites, mobile applications, and related Services provided by Cristeros, an initiative of Aequitas Education, a New Mexico-based 501(c)(3) nonprofit organization. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1) Eligibility & Accounts
You must be at least 13 years old (or the age of digital consent where you live) to use the Services. To create an account, you must provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account.
2) Donations & Receipts
Donations support our charitable mission. Unless we state otherwise in writing or required by law, all donations are final and non-refundable. We may provide tax receipts consistent with U.S. law; consult your tax adviser regarding deductibility. Donations are processed by third-party payment processors; we do not store full payment card numbers.
3) User Conduct & Community Standards
You agree not to:
- Violate laws, regulations, or third-party rights;
- Post or transmit unlawful, harassing, defamatory, obscene, hateful, or violent content;
- Impersonate others or misrepresent affiliation;
- Interfere with, disrupt, or attempt to probe or test the security of the Services;
- Upload malware or engage in spamming, scraping, or automated data collection without permission;
- Use the Services to advertise or solicit unrelated commercial activities.
We may moderate, remove, or restrict content or accounts at our discretion to protect users, enforce these Terms, or comply with law.
4) User Content & Licenses
You retain ownership of content you submit (“User Content”). You grant Cristeros a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/display), publish, and display your User Content solely to operate, improve, and promote the Services. You represent that you have all rights necessary to grant this license and that your User Content complies with these Terms.
We may remove or disable access to any User Content that violates these Terms or applicable law.
5) Intellectual Property
The Services, including content, logos, and software, are owned by Cristeros or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for noncommercial, lawful purposes. All rights not expressly granted are reserved.
6) Mobile App; App Store Terms
If you download our app from Apple App Store, Google Play, or similar, your use is also subject to the store’s terms. The store provider is not responsible for providing support or handling claims; all claims must be directed to us. You represent you are not in a country subject to U.S. embargo or on any U.S. government restricted list.
7) Third-Party Services
The Services may integrate or link to third-party services (e.g., payment processors, authentication providers, analytics). We are not responsible for third-party services. Your use of them is governed by their terms and policies.
8) Privacy
Our use of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms.
9) Beta Features & Changes
We may release features labeled as alpha, beta, or preview. These may be unstable or change at any time. We may modify or discontinue any part of the Services with or without notice, consistent with applicable law.
10) Disclaimers
To the fullest extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that content will be accurate or reliable.
11) Limitation of Liability
To the fullest extent permitted by law, Cristeros, Aequitas Education, and their directors, officers, employees, volunteers, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, goodwill, data, or other intangible losses, arising out of or related to your use of or inability to use the Services, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our aggregate liability for all claims related to the Services will not exceed the greater of (a) $100 or (b) the total amount you paid (if any) to us for use of the Services in the 12 months preceding the event giving rise to liability. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the maximum extent permitted.
12) Indemnification
You agree to defend, indemnify, and hold harmless Cristeros, Aequitas Education, and their directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your violation of any third-party right.
13) Termination & Suspension
We may suspend or terminate your access to the Services at any time and for any reason, including for violation of these Terms or to protect the Services or users. You may stop using the Services at any time. Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, liability limits, indemnification, dispute resolution).
14) Governing Law; Venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-laws principles.
15) Dispute Resolution; Arbitration; Class Action Waiver
Please read carefully: You and Cristeros agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Services through binding individual arbitration administered by the American Arbitration Association (AAA) under its then-current rules. You waive any right to a jury trial and agree that class actions and class arbitrations are not permitted. The arbitration will take place in McKinley County, New Mexico (or by remote video conference, if agreed). Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@cristeros.co with your full name and a clear statement that you wish to opt out.
16) DMCA / Copyright Complaints
If you believe content infringes your copyright, send a notice to copyright@cristeros.co including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location; (d) your contact information; (e) a statement of good-faith belief that use is not authorized; and (f) a statement under penalty of perjury that the information is accurate and that you are the copyright owner or authorized agent.

We strive to make the Services accessible. If you experience barriers, contact accessibility@cristeros.co.
18) Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms and revise the “Effective Date.” Your continued use of the Services after changes become effective constitutes acceptance.
